Declarant transition document checklist
Transition is a sequence of document, operational and physical handoffs. Prepare a common record for the developer, association, counsel and technical advisers before agreeing that the handoff is complete.
Map rights and duties separately
Ownership of a parcel, a reserved declarant right and responsibility for maintenance may sit with different parties. Trace each instrument through its actual assignments instead of assuming one transfer moves everything.
Match the paperwork to the field
Walk the roads, drainage and amenities with qualified professionals. Record what exists, what remains incomplete and what has been accepted. A marketing description does not establish engineering completion.
Keep a handoff register
For each asset or record, identify the transferring party, receiving party, evidence of delivery and unresolved conditions. Have project counsel assess the governing instruments and applicable law; this worksheet does not determine a legal transition date.
